These Terms of Service (“Terms”) govern your access to and use of the Kreator website, application, APIs, and related services (collectively, the “Services”), operated by Kreator, Inc. (“Kreator,” “we,” “us,” or “our”).
By accessing or using Kreator, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

These Terms define the rules for using Kreator and explain what you can expect from the platform.
2. Eligibility and Accounts
You must be at least 18 years old to use Kreator. By creating an account, you confirm that you meet this requirement and that the information you provide is accurate and current.
You are responsible for:
Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Ensuring anyone accessing Kreator through your account complies with these Terms
We may suspend or terminate accounts that violate these Terms or applicable laws.

You’re responsible for your account and how it’s used.
3. The Kreator Services
Kreator provides tools that allow users to generate creative assets (including images, videos, text, and audio) using artificial intelligence models and third-party services.
The Services may include:
AI-generated creative content
Asset storage and management
Integrations with third-party platforms
Subscription plans and usage-based credits
We may modify, improve, restrict, or discontinue parts of the Services at any time.
What this means for you:
Kreator helps you create content using AI, and the product may evolve over time.
4. User Content, Generated Content, and AI Models
a. Your Content
You retain ownership of any content you upload to Kreator (“Input Content”).
By uploading content, you grant Kreator a limited, non-exclusive, worldwide license to use, process, and store that content solely to operate and provide the Services.
b. Generated Content
Subject to your compliance with these Terms, you may use content generated for you by the Services (“Generated Content”) for lawful business and commercial purposes.
You are responsible for how you use Generated Content, including compliance with laws, platform rules, advertising policies, and third-party rights.
c. Model Training
Kreator does not train its AI models, or third-party models used by the Services, on customer-uploaded content or Generated Content.
d. AI Limitations
AI-generated content may be inaccurate, incomplete, misleading, or inappropriate in certain contexts. Kreator does not guarantee factual accuracy, legal compliance, or suitability for any specific purpose.
You are responsible for reviewing, editing, and validating Generated Content before using or publishing it.
e. Advertising and Marketing Compliance
If you use Generated Content for advertising, promotions, endorsements, or sponsored communications, you are solely responsible for ensuring compliance with all applicable advertising, consumer protection, and disclosure laws and regulations, including but not limited to FTC guidelines, platform-specific advertising policies, and local or international marketing laws.
Kreator does not review, validate, or certify Generated Content for advertising compliance and makes no guarantees that such content complies with advertising or disclosure requirements.
What this means for you:
Kreator helps create ads, but you are responsible for disclosures, claims, and compliance.
5. Prohibited Uses and Content Restrictions
You may not use Kreator to:
Violate laws or regulations
Infringe intellectual property, privacy, or publicity rights
Generate or distribute harmful, deceptive, or illegal content
Impersonate individuals or organizations without authorization
Attempt to bypass safeguards, usage limits, or pricing mechanisms
Kreator reserves the right to restrict, block, remove, or refuse to generate certain categories of content at its discretion, including categories required to comply with laws, platform policies, third-party provider rules, or risk management considerations. Kreator may restrict or block content categories related to regulated advertising, deceptive marketing practices, or claims that present elevated legal or compliance risk.
What this means for you:
Some types of content may be limited or blocked, even if technically possible to generate.
6. Subscriptions, Credits, and Payments
Some features of Kreator require a paid subscription and the use of credits.
a. Subscription Credits
Credits included with a subscription:
Renew each billing period (monthly or annually)
Expire at the end of the active subscription period
Do not carry over to the next period
b. Add-On Credits
Credits purchased separately as add-ons
Remain valid only while the account has an active subscription
Expire immediately if the associated subscription is canceled or expires
Credits are non-transferable and have no cash value.
c. Refunds
Refunds are available within 30 days of purchase, provided that no credits have been consumed during that period. Once any credits are used, purchases become non-refundable unless required by law.
We may change pricing or plans with reasonable notice.
What this means for you:
Credits reset with subscriptions, add-ons depend on an active subscription, and refunds require unused credits.
7. Third-Party Services and Publishing Integrations
Kreator may integrate with third-party platforms and services, including publishing and distribution services such as social media platforms, advertising platforms, or content hosting services (“Third-Party Services”).
By using these integrations:
You authorize Kreator to transmit content and related data to the selected Third-Party Service
You acknowledge that Third-Party Services operate under their own terms, policies, and enforcement mechanisms
You accept that content published via integrations may be reviewed, rejected, removed, restricted, or penalized by those platforms
Kreator is not responsible for:
Platform enforcement actions, account restrictions, or takedowns
Loss of reach, monetization, or account standing
Changes to third-party APIs, policies, or availability
You acknowledge that publishing content through Third-Party Services does not relieve you of responsibility for compliance with those platforms’ advertising, endorsement, disclosure, or content policies, even if content is generated or published using Kreator.
What this means for you:
Publishing through Kreator doesn’t override the rules of YouTube, Meta, or other platforms—you’re still accountable there.
8. Availability and Disclaimers
The Services are provided on an “as is” and “as available” basis.
We do not guarantee that:
The Services will be uninterrupted or error-free
Generated Content will be accurate, compliant, or accepted by third parties
Outputs will meet regulatory, advertising, or platform-specific requirements
What this means for you:
Kreator reduces effort, not responsibility.
9. Limitation of Liability
To the maximum extent permitted by law, Kreator shall not be liable for:
Indirect, incidental, or consequential damages
Loss of profits, data, or business opportunities
Issues arising from Generated Content, publishing outcomes, or third-party services
Our total liability for any claim will not exceed the amount you paid to Kreator in the twelve months preceding the claim.

We cap liability to keep the service viable and affordable.
10. Termination
You may stop using Kreator at any time.
We may suspend or terminate access if:
You violate these Terms
Your use poses legal, compliance, or security risks
Required by law
Upon termination, access to the Services will end, and data handling will follow our Privacy Policy.
What this means for you:
You can leave anytime; serious violations may result in loss of access.
11. Changes to These Terms
We may update these Terms from time to time.
Updated Terms will be posted on our website with a new effective date. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

If you keep using Kreator after updates, the new rules apply.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

California law applies in case of dispute.
